In Japan when you sign a lease contract for a house or apartment you may be surprised by the number of documents you need to sign or stamp. In this post, we will explain the different sets of documents and agreements that come with the lease contract
1- The lease agreement and the Explanation of Important matters regarding the contract
The lease contract comes with a second document that is called “The explanation of important matters” (重要事項説明書:Jūyō jikō setsumeisho)
This is a detailed explanation of the contract which is often based on a template. Compared to this the document called the Lease Agreement is more like a summary of this document. These two documents together make the lease contract. Both need to be signed.
2- Dispute Prevention Ordinance
These are rules set to prevent any dispute that may happen between the tenant and the landlord during the cancellation of the contract. These rules give a guideline about who is responsible for what kind of damages and to what extent when it comes to restoring the house to its original condition.
3- Guarantor company contract
This is a separate contract between the guarantor company and the tenant. The guarantor company assigned by the owner agrees to guarantee the payment of the rent and any damages in case the tenant fails to fulfill those obligations. In return, the tenants pay the initial guarantor company fee and a yearly or monthly fee to the guarantor company.
4-Fire insurance or house insurance
This is a 1-year or 2-year insurance contract that covers not only fire but many other accidents. Depending on the insurance package usually the belongings of the tenant, hospital bills, and damages to the house and neighbors are covered.
